L’Oreal wins case against copycat perfumes…

In a case that may have far-reaching implications for the perfume industry, L'Oreal has won a lawsuit against a company that copied the "olfactory architecture" of its fragrances:

A scent is a work of art just like a painting or a symphony, a French court has ruled in a case seen as a major victory in the battle against copycat fragrances.

After decades of failed attempts to copyright a particular perfume, cosmetics giant L'Oreal finally persuaded the court that its perfumes were entitled to the French droits d'auteur (authorial rights) that protect their creators from imitation for 70 years.

Remember the radio host who says she was sickened by a colleague's perfume and then fired unjustly when she complained? She was originally awarded 10.6 million dollars in a federal lawsuit. Then a judge knocked that back to $814,000. Now, that same judge has increased the award to $1.2 million (link to article no longer working, sorry!) in damages plus $423,807 for legal costs.

And in a related story from Connecticut (link no longer working, sorry!), a woman with “multiple chemical sensitivity disorder” is suing city officials who she says have failed to address her co-workers use of fragrance products…

Perfume lawsuit update

The woman who was awarded 10.6 million dollars after claiming that a co-worker's Tresor perfume made her sick has had her award lowered to $814,000 by a judge in Detroit. (via United Press International; link to article no longer working)

Ebay & perfumebay lawsuit & other perfume news

Ebay and Perfumebay are still fighting over whether the name "Perfumebay" infringes Ebay's trademark. A judge has ruled that Perfumebay can continue to use the name until the case is decided.

The sweet, syrup-like smell that puzzled New York City authorities back in October was apparently back yesterday afternoon.

A radio host who says she was sickened by a colleague's perfume — Lancome Tresor — and then fired unjustly when she complained, has been awarded 10.6 million dollars in a federal lawsuit. 2 million of that was for "mental anguish". (via The Detroit News)
