Four European and American fragrance makers must face lawsuits

Four European and American fragrance makers must face lawsuits accusing them of conspiring to inflate prices of ingredients used to make cosmetics, cleaners and other household products, a federal judge in New Jersey has ruled.

U.S. District Judge William Martini on Friday rejected efforts by the companies — Switzerland-based Givaudan and Firmenich, which has merged with DSM Group; U.S.-based International Flavors & Fragrances and Germany's Symrise — to dismiss three proposed class action lawsuits filed in 2023 by consumers and other buyers.

Very close to natural sandalwood

“Consumers are more conscious and concerned about the impact of what they buy and how products are produced,” says François-Raphaël Balestra, perfumer and director of new-ingredients discovery at DSM-Firmenich. One of the house’s ingredients is Dreamwood, a lab-grown iteration of sandalwood that has made its way into popular scents like Jean Paul Gaultier Scandal Le Parfum and Rabanne Fame. “Olfactorily speaking, Dreamwood is very close to natural sandalwood oil,” he says. “It is less smoky and thus more creamy, but it has the same long-lasting effect as sandalwood and is of course more sustainable.”

The team’s goal is simple: Incorporate scents that repel mosquitoes into everyday products. After doing extensive research into the household products used most frequently in places where mosquito-borne diseases are common, they decided to focus mostly on bar soap and powdered laundry detergent. (They’re also thinking about other things like body lotion and body cream.) These products are already scented with a fragrance—what if that fragrance also helped keep mosquitoes away?

A prospective class action

A prospective class action filed in a New Jersey, US court last week has become the latest case mounted against fragrance giants Givaudan, Firmenich, International Flavors & Fragrances (IFF) and Symrise.

The lawsuits follow the announcement of investigations by antitrust authorities in Switzerland, Europe, the UK and the US into suspected pricing collusion earlier this year.

Hammered

Shares in Givaudan and Symrise were hammered today after the Swiss antitrust agency named them as part of a quartet of companies in the crosshairs of international competition watchdogs.

Swiss competition commission COMCO said its probe was targeting market leaders Givaudan, domestic rival Firmenich, which is merging with Dutch chemicals group DSM, US-based International Flavors & Fragrances and Germany's Symrise.
